SC directs NCDRC to dispose off cases of 231 Unitech Vistas & Residences buyers in 8 weeks
NEW DELHI: The Supreme Court on Friday directed the National Consumer Disputes Redressal Commission (NCDRC) to dispose of cases related to 120 home buyers of Unitech Vistas and 111 buyers of Unitech Residences projects within 8 weeks.
A Supreme Court bench headed by Justice Dipak Misra also directed Ramesh Chandra, chairman of real estate firm Unitech, managing directors Ajay Chandra and Sanjay Chandra and all the other directors of the company to be present in the court on May 8, when other cases against the company is also coming up for hearing.
The apex court also did not entertain a comprehensive 150-page proposal by Unitech to complete their projects.
"Unitech submitted their proposal and broadly requested the court to not direct refunds to home buyers so that they have liquidity to complete their projects. However, I objected to the proposal and requested the the to ask NCDRC to expedite their cases," said ML Lahoty, the lawyer who represented the Vistas and Residences home buyers.
All the 231 buyers have demanded refund for the delays in their projects.
The court also reiterated said that all proceedings in cases against Unitech and its directors before different courts and forums will continue, informed Lahoty.
The company on February 27 proposed before the Supreme Court to submit a comprehensive scheme for dealing with completion of the pending projects and refunds for home buyers. However, it had failed to submit the proposal on March 27, which it finally did today.
Unitech Vistas project in Sector 70 of Gurgaon was launched in 2009, and was scheduled be delivered in December 2012. The project has 1,265 apartments in 23 towers with 14 floors each. While The Residences project in Sector 117, Noida with 443 units was launched in May 2009 and the developer was to give possession of the flats by the end of 2011.
Around 13,337 home buyers in 41 projects of Unitech, primarily in Noida and Gurgaon, are stuck due to delay.
