News: UP RERA to take legal action against developers for misleading progress report of the project-20-12-2020

(UP-RERA) said that it will take legal action against builders who are uploading wrong photographs in the progress report of the project. During the rst regional RERA Samvaad - Varanasi Edition, Ashish Gupta, a homebuyer pointed out that the promoters are uploading the photographs not related to their project but some other project or site which has made more progress. “It is the statutory responsibility of the promoter to provide accurate information relating to the projects on the website of the authority and also to homebuyers. Any misrepresentation by the promoter is punishable under the Act,” UP RERA chairperson Rajive Kumar said. Kumar advised the homebuyers to verify the details of the promoter and the project on the website of the UPRERA before making an investment for an apartment or plot
“The objective of registration of the real estate projects is to bring all the important details of the project in public domain and giving the homebuyers an opportunity to keep a track on the progress of the project. The homebuyers also have the right to approach RERA for enforcement of their claim in case the promoter violates the provision of RERA Act
Kumar said that UPRERA has followed the online management of the complaints since its inception and had switched over to e-Courts system in February 2020 prior to the lockdown due to COVID-19 pandemic. Homebuyers have been able to virtually participate in the hearing of their cases from the countries as far as United States, Brazil, United Kingdom, Dubai, and in some cases the homebuyers have joined the hearings from hospital beds including COVID- 19 wards.
