News: High Court rules Haryana town planning department can still act in licensed colonies within Gurugram corporation limits-25-09-2026
The Punjab and Haryana High Court has held that licensed colonies within the limits of the Municipal Corporation of Gurugram (MCG) remain subject to regulation by the Department of Town and Country Planning (DTCP), which grants colony licences under the Haryana Development and Regulation of Urban Areas Act, 1975.
The order, made available on Wednesday, came from a September 7 hearing on petitions by the DLF City Residents Welfare Association and another party against the State of Haryana, challenging action by the DTCP enforcement wing against construction violations.
A bench of Chief Justice Ashwani Kumar Mishra and Justice Rohit Kapoor said the 1975 Act applies to all urban areas in Haryana, including municipal limits, and that including a licensed colony within MCG limits does not extinguish the jurisdiction it confers. It said the director’s powers under Section 10 flow from the licence granted under sections 3 and 3B, not from where the land lies.
The petitioners had argued that DTCP jurisdiction ends once MCG takes over a private colony. The court noted that the Haryana Municipal Act, 1973 and the Haryana Municipal Corporation Act, 1994 do not transfer or alter the 1975 Act powers over licensed colonies, and rejected the preliminary objection on the jurisdiction of the District Town Planner (Enforcement), Gurugram.
DTCP enforcement has issued notices to owners of around 8,000 properties and passed restoration orders for 6,000. Action covered 102 properties in DLF Phases 3 and 4, with others in Sushant Lok-1, South City-1 and Palam Vihar, including sealed guest houses and commercial units and demolished illegal constructions in stilt areas.
District town planner (enforcement) Amit Madholia said the order affirms that the department has full authority under the 1975 Act within town planning areas. The next hearing is on October 13.
