News: NCLAT gives Supertech apex court committee two weeks to report on stalled NBCC projects-03-09-2026
The National Company Law Appellate Tribunal (NCLAT) has directed the committee overseeing Supertech’s stalled projects to file a status report within two weeks on starting construction and awarding work in 16 NBCC-managed projects, after homebuyers complained of delays.
Under its May 6, 2026 order, work awarding was to begin before July 31, 2026 and construction within a month after, but these timelines were missed. The bench, headed by Officiating Chairperson Justice Yogesh Khanna, also noted that employees have not been paid for three months, as raised by R K Arora of Supertech’s suspended board, and asked the Apex Court Committee to consider it.
NCLAT constituted the committee on December 12, 2024 and told NBCC to complete the 16 projects. The bench also noted water-logging in basements at Supertech Ecociti and Supertech 34 Pavilion and asked Arora’s counsel to take instructions on furnishing original plans.
The committee has filed a status report; the promoter, who received it only a day before the hearing, was given a week to respond. The tribunal also heard a plea to substitute the committee for the IRP, who was removed as its Chairperson, and asked the committee to speed up the new IRP’s appointment. The tribunal also noted that the applicants seeking legal fees for the IRP’s lawyers have already approached the committee, which may take a view. Counsel for Arora said the incoming IRP would serve as the committee’s secretary, making substitution necessary, while creditors opposed it and sought time to reply; the respondent was asked to reply within a week.
The next hearing is on September 14, 2026. Supertech has been in insolvency since March 20, 2021, when the NCLT admitted a plea by its lead lender, Union Bank of India.
