News: Court Bars DHBVN Power Cut at Suncity Avenue Sector 102-27-08-2026
A city court has restrained Dakshin Haryana Bijli Vitran Nigam Limited (DHBVN) from disconnecting electricity to Suncity Avenue in Sector 102, home to at least 800 families, over a disputed Rs 96.84 lakh demand raised retrospectively from 2019 for excessive commercial-category consumption.
Civil judge Jasmeet Singh granted interim relief on Monday, at the first hearing of an application by the society’s Residents Welfare Association (RWA). The court observed that the Supreme Court has recognised access to electricity as a facet of the right to life under Article 21, and that disconnection would have serious consequences for many families while the dues dispute, which lies between DHBVN and the realty firm, could be adjudicated in accordance with law. The next hearing is on October 8.
Advocate Seema Nain, for the RWA, submitted that residents had no liability. DHBVN counsel BP Sharma argued the RWA was not the consumer and the demand was against the realty firm, whose counsel Akshay Gupta was directed to file a reply.
Suncity Avenue has a single-point connection. DHBVN audited such societies last year and raised bills where it calculated that more than 15% of sanctioned load was used commercially. The commercial tariff is Rs 7.10 per unit, against Rs 5.80 for bulk domestic supply.
RWA documents show bills of Rs 15 lakh and Rs 20 lakh in March and April, and Rs 1.17 crore in May, including the Rs 96.84 lakh.
RWA general secretary PN Mishra said the realty firm managed everything till October 2024 and residents could not afford the amount.
