News: High Court Bars Fresh Allotments at Oberoi 360 North-09-07-2026
The Punjab and Haryana High Court has restrained Oberoi Realty from making fresh allotments or creating third-party rights in its ’Oberoi 360 North’ residential project in Gurugram until the Haryana Department of Town and Country Planning (DTCP) decides a pending complaint against the validity of the project’s licence, PTI reported.
A division bench of Justices Jasgurpreet Singh Puri and Sanjiv Berry passed the order on a plea by Advance India Projects Ltd (AIPL) in an ongoing writ petition against the DTCP director, Haryana, and others.
AIPL has sought a stay on License No. 69 of 2025, issued on May 12, 2025, and on the order of June 17, 2025, approving transfer of the licence to another developer. It has also claimed rights over the project and sought cancellation of the sale deed in favour of Oberoi Realty. The dispute concerns a 14.816-acre parcel in Sector 58.
The petitioner alleged that the grant and transfer of the licence violated the Haryana Development and Regulation of Urban Areas Act, 1975, and breached foreign direct investment (FDI) conditions, arguing that FDI is meant for development and not for enabling an exit through sale of the project. The private respondents contested this. The bench recorded these as allegations and gave no finding on merits.
The petitioner’s counsel submitted that the project is valued at around Rs 8,000-10,000 crore, that nearly 350 units had been allotted and around Rs 750 crore collected, and that further sales could complicate prospective buyers’ rights.
The Haryana government said AIPL’s representation for cancellation of the licence under Section 8 of the 1975 Act is pending before the DTCP director and listed for July 20, and all stakeholders would be heard.
AIPL also said it had an FIR registered in 2024 against IREO and Oberoi Realty alleging collusion and cheating over the same land. Proceedings in it are stayed by the Supreme Court.
In a regulatory filing on Thursday, Oberoi Realty said the order would have no adverse impact on its business operations. Construction of the Rs 16,000 crore project has not been stayed and concluded sales are unaffected, it said, adding that it would "pursue necessary legal course of action".
