News: UP RERA Caps Fee at Rs 1,000 for Heirs of Unregistered Flats-08-06-2026

Developers in Uttar Pradesh can no longer charge more than Rs 1,000 as processing fee for transferring an unregistered inherited property within blood relations. UP RERA has fixed the cap in what is described as a first-of-its-kind step by a RERA authority, giving relief to legal heirs who have often faced hefty demands. For transfers to people outside the family, promoters may charge at most Rs 25,000.

To avail of the transfer, heirs must submit documents such as the death certificate, a succession certificate issued by a competent authority and no-objection certificates from the other legal heirs.

What transfer charges are

Developers usually levy transfer charges when an original allottee or a later buyer passes on rights in an under-construction property to someone else before the final sale or conveyance deed is executed. Because the allottee’s details sit in the developer’s books, any change requires the records to be updated and the transfer approved. The same applies when an allottee dies and the rights pass to legal heirs.

Sunil Tyagi, Managing Partner, ZEUS Law Associates, explained that the builder collects these charges when approving the transfer in favour of the new transferee. Some administrative cost may arise from verifying documents, compliance checks and updating records, he said, but without a clear regulatory framework the charges have often been excessive and out of proportion to the work involved.

Why the regulator stepped in

The move follows a series of complaints from homebuyers and heirs that developers were demanding large sums to transfer apartments after the original allottee’s death. In several cases the fee was linked to the size of the flat, adding to the burden on bereaved families.

The cap has been prescribed through the 10th Amendment to the Uttar Pradesh Real Estate Regulatory Authority (General) Regulations, 2019. It separates succession-based transfers from commercial ones: inheritance transfers and transfers among family members attract a maximum of Rs 1,000, while other transfers are capped at Rs 25,000.

Experts welcome the cap

Legal and real estate experts have welcomed the decision, saying inheritance should not be a source of revenue for developers.

Sonam Chandwani, Managing Partner, KS Legal & Associates, called it a practical reform that addresses a problem families face at a very difficult time. Heirs, she said, often have to deal not only with succession formalities but also with developers seeking substantial amounts merely to record the flat in their name. By capping the fee, the regulator has recognised that inheritance is a legal consequence of death and not a commercial transaction.

She said the main benefit is the removal of an unnecessary financial burden and less room for arbitrary demands. A legal heir does not buy the property from the developer but derives rights through succession law and steps into the shoes of the deceased allottee. The developer’s role is confined to checking documents and updating records, so hefty fees were hard to justify, especially when the original purchaser had already paid the full consideration.

Chandwani drew a distinction between a voluntary transfer, where an owner sells to a third party, and a succession-based transfer that happens automatically by operation of law. In the second case the heir acquires no new right from the developer, and a promoter cannot treat every change of ownership as a fresh business opportunity. Making heirs pay substantial charges just to record an existing right, she said, serves little legal purpose and often amounts to "unjust enrichment" for the developer.

How other states compare

According to Chandwani, UP RERA appears to be among the first to expressly lay down a nominal cap through a specific regulatory framework. Maharashtra and Delhi have mechanisms for transmission of ownership and succession matters, she said, but no similarly clear and uniform RERA-led provision fixing inheritance transfer charges at a nominal sum.

She said the provision brings certainty and sharply limits the discretion developers earlier enjoyed. If other state regulators follow, it could help establish a national principle that succession is a legal entitlement and not a revenue-generating event for builders.
