News: MahaRERA Orders Usable Alternate Parking for Pune Buyer-09-04-2026
The Maharashtra Real Estate Regulatory Authority (MahaRERA) has directed a developer to allot a homebuyer an alternate parking space until the one sold to him is constructed, holding that a slot allotted only on paper does not meet the developer’s obligation.
In its order, the authority said a developer who has collected consideration for a covered car parking space must provide one that is usable. Allotting a slot in a building still under construction and unavailable for use cannot be treated as proper allotment. It ordered that a "reasonably accessible" space be given within three months.
The buyer purchased an apartment with one covered parking space in a Pune project in February 2020. He said possession of the flat was given in March 2024 but the parking was not usable. He was assigned a temporary open space in another building, while his permanent slot lay in a structure under construction. He also alleged that the permanent slot was in building A (name changed) though his flat is in building G, and the two are far apart.
The developer responded that in an integrated township it is not always possible to give each owner parking below or beside their tower, so slots are allotted in nearby towers or designated areas. It said allotment strictly followed a seniority list in which earlier bookings rank higher, and that the parking clauses in the agreement for sale give the buyer no right to choose or demand a particular slot.
MahaRERA noted that the agreement may not confer an absolute right to demand a slot in a specific tower.
