News: No Fixed Sale Deed Format Under RERA, TG RERA Rules-17-03-2026
The Telangana Real Estate Regulatory Authority (TG RERA) has dismissed a homebuyer’s claim for interest on Rs 62.5 lakh paid towards an apartment that he cancelled after the developer declined to amend the draft sale deed. In its order dated March 13, the authority held that a buyer cannot insist on a particular sale deed format.
According to the order, the promoter’s staff emailed a draft sale deed for verification and asked the complainant to point out corrections. He found what he considered several omissions required under RERA and the registration rules, including on title documents, parking details and TDS references, and sought revisions before making the final payment and registering the deed.
The developer maintained that the draft complied with the law. The order records the buyer’s account that staff called the deed final and non-negotiable and told the buyers to accept it as it was or withdraw. The buyer withdrew, saying he was compelled to, and sought a full refund with interest. During the proceedings the developer returned the entire Rs 62.5 lakh, but contested the interest claim and denied wrongdoing.
TG RERA observed that neither the Real Estate (Regulation and Development) Act, 2016, nor the Telangana RE(R&D) Rules, 2017, prescribe any mandatory or uniform format for a sale deed. The statutory framework offers a model format only for the agreement for sale, to ensure transparency at the pre-conveyance stage. A sale deed, as an instrument of conveyance, is governed mainly by applicable laws and the contractual understanding between the parties, it said, and an allottee cannot demand clauses or formats that the law does not require.
The authority found the objections were largely drafting preferences and did not establish statutory non-compliance. With no violation of the Act shown and no proof that the promoter failed in any statutory obligation, it ruled that the complainant was not entitled to the reliefs sought and that the complaint was "devoid of merit".
