News: No court stay, sealing drive to go on in Gurugram: DTCP-12-08-2023
The department of town and country planning (DTCP) will go ahead with the sealing drive in the city after a local court refused to stay the process, an official said on Friday.
“Around 25 petitions were filed by property owners in a Gurgaon court, seeking stay on the ongoing drive. Our legal team represented the
department after which the court did not give any relief and directed that action can continue as per the norms,” a department official said. By the end of the month, DTCP aims to seal 200 properties where illegal commercial activities are going on. The enforcement wing of the department on Thursday sealed illegally run shops at Parsvnath Exotica in Sector 53 and commercial establishments at the Suncity township in Sector 54 along the Golf Course Road. A police team had accompanied DTCP officials.
Action was taken based on complaints received on the CM Window portal and confirmed in a survey by the department, officials said.
“A milk booth along with three shops running illegally in Parsvnath Exotica Group Housing Society were sealed in Sector 53. After this, the enforcement team reached Suncity Colony and sealed five illegal commercial establishments that included PG accommodations being run from two houses, dental clinics at two houses and a commercial office in another house,” district town planner (enforcement) Manish Yadav said.
The DTP also said that the department has recently received 25 applications to allow ‘non-nuisance activities’ at commercial areas.
‘Non-nuisance activities’ refer to offices of property dealers, CAs and lawyers, and medical clinics among other trades that are allowed on 25% of the ground floor of a residential property“After the show cause notices were issued regarding illegal commercial activities in various licenced colonies, we have received 25 applications under the rules of non-nuisance activity. If granted, the department will get revenue and these establishments will be recognised by DTCP,” Yadav said.
He added: “There is a target to seal 200 commercial establishments in residential areas this month. The responsibility is with the DTP enforcement wing to ensure that there is no laxity in following the norms.
