News: Builder sells land to another, DTCP goes to cops for FIR.-25-02-2023
According to DTCP officials, KN Infracon Pvt Ltd submitted an application on June 15, 2 for the migration of its 2010 licence granted for a group housing colony on 11.381 acres in Sector 106 into an affordable housing colony.
After cancelling its project licence, the department of town and country planning (DTCP) has recommended registration of an FIR against the developer of an affordable housing for forgery and cheating.
The developer is accused of irregularities in converting its group housing licence into an affordable housing scheme by keeping the department in the dark about the ownership of the project land. It is also accused of selling its licenced land to another developer as agricultural land and causing revenue loss to the state exchequer.
According to DTCP officials, KN Infracon Pvt Ltd submitted an application on June 15, 2020, for the migration of its 2010 licence granted for a group housing colony on 11.381 acres of land in Sector 106 into an affordable housing colony. At this time, KN Infracon was not the owner of the land as the same was sold to Trutrust Analytics Pvt Ltd (now MRG Castel Reality) on October 23, 2019.
"From perusal of the records and all submission of the rival parties, it is evident that actually the land changed hands on October 23, 2019, from KN Infracon Pvt ltd to Trutrust Analytics Pvt Ltd whereas the application for migration was moved by KN Infracon on June 15, 2020. This clearly established fraudulent intention on the part of the developer," the DTCP wrote to Gurgaon police.
As per the letter, the sale of licenced land was executed by declaring the land as agricultural and in process causing loss of stamp duty to the state exchequer. The loss was caused to DTCP by way of external development charges and internal development charges.
"We have recommended the registration of an FIR for forgery and cheating against the developer," said senior town planner Sanjeev Man. The developer could not be contacted.
