In their complaint, the residents claimed that the RWA was also not allowing courier and grocery delivery at their doorsteps and even stopping the entry of visitor’s vehicles “over non-payment of maintenance charges, an issue which is sub-judice”.

GURUGRAM: Some residents of CHD Avenue 71 have filed a police complaint, alleging that the RWA has been harassing them by restricting their entry and exit to the Sector 71 housing society as well as their access to common facilities like the club, the swimming pool and power back-up.

In their complaint, the residents claimed that the RWA was also not allowing courier and grocery delivery at their doorsteps and even stopping the entry of visitor’s vehicles “over non-payment of maintenance charges, an issue which is sub-judice”.

According to the aggrieved residents, a civil suit was filed by some homebuyers after the RWA, without their consent, took over the maintenance of the society from the builder in May 2018. Later, the district court restrained the developer from handing over the facility and maintenance contract to any third party till further orders, the residents said. The next hearing is slated for July 15.

Gaurav Kalra, a resident, said, “This is nothing but the dictatorship of the RWA. First they forcefully took over the society’s maintenance from the builder and are now harassing us to abide by their rules.”

Anil Razdan, another resident, alleged that the RWA has ordered the society’s guards not to allow any delivery personnel or visitors to enter the premises. “It is completely illegal. The whole takeover process was dubious, which we have challenged but the RWA is trying to intimidate us.”

However, the RWA claimed that some of the residents have defaulted and the upkeep fee to the tune of Rs 1.25 crore toward common area maintenance (CAM) has been pending.

“In the past three years, these defaulters have availed all the facilities, be it essential or non-essential. They are taking full advantage of the slow judicial process,” he added.

When contacted, Sandeep Singh, SHO of Badshapur police station, said, “We have received the complaint and a probe is on. If there is any kind of restriction on the entry and exit by the RWA, then appropriate action will be taken as per law.”
