News: Housing ministry to assess extent of dilutions in rules by states of central RERA-14-05-2022

NEW DELHI: The housing and urban affairs ministry is compiling the rules notified by state governments under the real estate law, RERA, to assess the extent of dilutions they have carried out compared to the Central Act, TOI has learnt.

This comes after the Central Advisory Council (CAC) headed by Union housing minister Hardeep Singh Puri recommended to the ministry to ensure that no entity dilutes the rules under RERA. “The Council observed that, being the custodian of RERA, this ministry has to aim for non-dilution of RERA,” the minutes said. The CAC has been established as per the provision of RERA law to advise and guide the government on implementation of the Central Act.

“Since we have all the rules notified by the states there is no need to seek details from them. We are compiling them and identifying what dilutions in the general rule have been done. But the bigger issue is dilutions in the builder-buyer agreement by states,” said a senior official.

The Supreme Court has asked the states and the Centre to compile the details of dilutions by May 15 and to submit whether the rules notified by them are in accordance with the central rules.

According to the minutes, while chairing the CAC meeting Puri made an observation on “dilution of RERA by some states in their rules framed under RERA”. Homebuyers’ representative in the council, Abhay Upadhyay had also flagged the dilutions.

However, barely four days after the council’s meeting the housing ministry had placed only the dilutions in the builder-buyer agreement by states before the Supreme Court.
