News: Gurugram: DTCP issues notices to 17 condominiums for giving possession without OCs-24-03-2022
In several towers of these projects developed by prominent realty companies like Unitech, Ansal, Vatika and Vipul, among others, families have been living for years without the mandatory document in violation of the Haryana Development and Regulation of Urban Areas Act, 1975, according to the town planner.
GURUGRAM: The town and country planning department (DTCP) has served showcause notices to the developers of 17 condominiums in the city for allegedly giving possession of flats to owners without procuring occupation certificates (OC) for their projects.
In several towers of these projects developed by prominent realty companies like Unitech, Ansal, Vatika and Vipul, among others, families have been living for years without the mandatory document in violation of the Haryana Development and Regulation of Urban Areas Act, 1975, according to the town planner. An OC is a document issued by the government certifying that a building has been constructed in accordance with norms and is ready for possession.
The process of issuing OCs and the government’s oversight mechanism for construction quality have come under intense scrutiny after a cave-in at Chintels Paradiso where the living rooms of five flats in Tower D collapsed vertically from the sixth to the second floors on February 10, leading to the death of two residents. District town planner RS Batth said the notice under section 10(2) of the Act has been served on 17 projects. “The licences were granted to the developers for building residential group housing colonies, but it has come to the notice of the DTCP that they offered possession of flats without procuring mandatory approvals," said the notice. Batth told TOI that during recent site visits, it was found that towers of several condominiums had been given for occupation by builders without obtaining OCs in violation of the conditions of approved building plans and in contravention of the provisions of Section 3b of the Act. “By giving unauthorised occupation to families without obtaining OCs, the developer is liable to penal action under Section 10 of the Act,” he said. The condominiums that have not obtained an occupation certificate, according to DTPC, are Uniworld City in sectors 30 and 41, World Spa in sectors 30 and 41, Uniworld Garden-2 in Sector 47, Fresco in Sector 50, Escape in Sector 50, Harmony in Sector 50, The Close North and The Close South in sectors 49, 50 and 57, The Residences in sectors 33 and 48, BSF Housing in Gwalpahari, Ansal Heights in Sector 92, Aloha in Sector 57, Gurugram 21 in Sector 83, Lifestyle Homes in sectors 81 and 85, Vatika City in Sector 49, Exotica in Sector 53, 54 and 57, Vipul Lavanya in Sector 81 and Gopal Dass Estate in Sectors 51, 52, 53 and 57 The developers of these projects have been directed to explain their stands via personal appearance along with a written reply on why they haven’t obtained the certificates and given possession of flats to owners, failing which an action will be initiated against them.
