News: Sub-registrar among five booked for illegal registry of land in Gurugram-18-03-2022

GURUGR AM: A subregistrar and four others have been booked for allegedly carrying out an illegal registry of a plot in Kadipur tehsil of Gurgaon district. The move comes a couple of days after chief minister Manohar Lal Khattar ordered a probe into the registration of all sale deeds since 2010. Sources said the registry of the land in Kadipur had been executed on the basis of a fake general power of attorney (GPA) and forged documents and signatures of the original landowner. The fraud came to light on February 28, when the original owner of the plot visited the revenue office in Gurgaon to get a document. Illegal registries have become a major challenge for the incumbent government in the state. A couple of days ago, the opposition MLAs had brought in a motion in the state assembly against illegal registries and sought to know from the government what action it had taken on complaints. This prompted Khattar to order the probe into all registries since 2010.
According to a government report, more than 64,577 illegal registries were executed in Haryana between 2017 and 2021. Of these, 21,932 illegal registries were reported from Gurgaon division (comprising Gurgaon, Rewari and Mahendragarh districts). A government investigation had also found the involvement of 76 patwaris from Gurgaon district in carrying out illegal registries, which gave rise to numerous unauthorised colonies. In the latest case, the land in Begampurkhatola village of Kadipur tehsil that was illegally registered is originally owned by Puran Manchanda (72), a Delhi resident. Manchanda said he and his wife had owned the 15 kanal plot for the past 30 years. “We never sold this land to anybody. Nor did we execute any power of attorney in any manner,” he said. On February 28, Manchanda had visited Patwar Bhavan in the city to get a revenue paper for his plot when he was shocked to find that the land was registered in someone else’s name. “I was told that someone called Bhim Singh Rathi was in the revenue office on February 24 to get the mutation of the land sanctioned in his name. This was obviously done on the basis of fake documents and forged signatures,” Manchanda said. The registry, he said, was executed in the office of the sub-registrar of Kadipur.
The process had other loopholes too.
“The accused had not mentioned his PAN in the sale deed. Nor was there any mention of the 1% TDS that is mandatory for execution and registration of sale deeds,” Manchanda said. Although the current value of the land is around Rs 50 crore, according to Manchanda, the sale deed showed it to be worth Rs 6.6 crore. The registry, Manchanda found, had been done on the basis of a forged GPA that was executed in September 1996 at a sub-registrar’s office of southeast Delhi. “The accused, in collusion with the sub-registrar of Kadipur and other revenue officials, executed the fake registry,” Manchanda said. Following a complaint at Badshapur police station, a case of cheating and under other relevant sections of the IPC was registered against one Subhash Yadav of Sushant Lok 1, Shel Narang of South City 2, and Bhim Singh and Vinod of Sector 4, the sub-registrar and other revenue department officials. Names of the revenue officials were not mentioned in the FIR. Gurgaon deputy commissioner Nishant Yadav said the process of investigating the registries since 2010 had already begun. “We will find out if there are any irregularities,” he added.
