According to K K Khandelwal, both the companies have not be responding to notices of the authority and not complying with the orders issued by it. “In several cases, we have asked them to pay the delay penalty to the homebuyers but they didn’t. After repeated reminders, we have now asked the police and local SHO to produce them. We will attach the property if they don’t comply with the order,” Khandelwal said. Order has been issued against the managing director of Sepset Properties Private Limited Adesh Kumar Tyagi and directors and managing director of Supertech Limited, Ram Kishore Arora, Anil Kumar Jain, G L Khera, Anil Humar Sharma, Mandeepa Joshi and Pradeep Kumar Goel (Managing Director) for noncompliance of the directions of the authority. Earlier, in the Sepset case, the authority had ordered attachment of bank account with the Indusland Bank, Barakhamba Road, New Delhi. “However, despite receipt of notice and reminder to the notice, the bank manger failed to comply with orders passes by the authority nor did he submit any report in this regard. Taking a serious view of this omission on part of the bank manager, the authority directed issuance of show cause notice to him as to why proceedings for non-compliance of order passed by the authority should not be initiated against him,” Khandelwal said. Also, authority issued a notice against the bank manager to appear before the authority for oral examination. “These decision of the authority are very significant and shall send across a clear message to all errant promoters who attempt to evade compliance of the directions of the authority or satisfaction of it decree on one pretext or the other,” Khandelwal added.
