News: ‘Blanket ban on property registry in Ardee City is not justified’-15-09-2021
Gurgaon: Residents of Ardee City are concerned over the blanket ban on the registration of properties in the colony after the licence of the developer was cancelled by the department of town and country planning (DTCP) last week.
Terming the decision “unjustified”, the residents said that they are being unnecessarily penalised for the wrongdoings of the developer and criminal negligence of the DTCP, which had granted the licence to the developer. They have demanded the lifting of a ban on sale deeds of properties owned and bought by the residents as they have already paid their dues. They also urged the government to file a case against the builder and the DTCP officials for the lapses. The decision has also impacted those who are in the middle of purchasing the properties.
The residents alleged that the department failed in due diligence before granting a license to the developer.
The RWA has already taken up the matter with the local MLA and deputy commissioner, seeking intervention in the matter. “The DTCP gave the license to the colony about 20 years ago. We purchased properties here because it was a licensed colony. DTCP gave OCs to plots and our properties got registered. There should be action against the DTCP as it gave the licence and is now cancelling it. The registry of only those properties should be banned if they are owned by the developer. Why should residents be penalised for the department’s and the developer’s wrongdoings,” asked Chaitali Mandhotra, adding that they are planning to meet the DG TCP on the matter soon.
DG TCP KM Pandurang said, “The decision was taken as per law after giving adequate time to the developer to respond. However, we will look into the concerns raised by the residents. There are some disputes between the developer and landowners. As a result, there is a lack of clarity on the title of the property.”
