News: Haryana: Registries of properties with plan violations may be stopped in plotted colonies-18-02-2021

GURUGRAM: The department of town and country (DTCP) has sought a halt to the registry of properties in licensed plotted colonies that have been constructed by violating building norms. The move, according to the department, will help make the sale and purchase of such properties difficult for owners.
District town planner (enforcement) RS Batth has written to tehsildars of Gurgaon, Wazirabad, Manesar, Badshapur, Kadipur and Garhi Harsaru to put on hold the registry of residential floors, which have been constructed by violating building rules, after procuring occupation certificates (OC). Batth said the registry will be paused till the time property owners restore the buildings as per norms.
In the letter to tehsildars, Batth said it has been found that despite increasing floor area ratio (FAR) for residential plots in these colonies, the residents as well as developers are committing serious violations after obtaining approval from the department.
FAR is the ratio of a building’s total floor area (gross floor area) to the size of the piece of land on which it is built. Last year, the planning department had increased the FAR of plots measuring 300 square yards to 264. For bigger plots, the FAR was 240.
“Therefore, the DTCP has initiated strict action against such offenders by carrying out demolition and sealing individual premises where violations have been found. A few offenders have requested us to de-seal their properties that have been built by violating norms. The department is de-sealing these properties for now with certain terms and conditions. However, parts of the buildings where violations are found should be removed within a specified period,” he said.
The department is, however, of the view that such building owners may get the sale deeds of independent floors executed. Also, these floors could be occupied by residents thereafter. In that case, an official said, it becomes difficult to take strict action.
“In view to keep strict vigil on such offenders, the DTCP often informs officials and the public about all such premises with request not to execute any registration of independent floors or plots till the offenders follow the terms and conditions,” he said, adding that decision was taken for better coordination to control the violations.
These violations often cause inconvenience to the floor buyers. Also, the floor buyers will have to face penalty and other departmental actions.
On February 1, the enforcement team of DTCP had partly demolished and sealed 10 newly constructed residential buildings in DLF-2 for zoning plan violations. The builders had constructed rooms in the stilt parking area and carried out violations in the zoning plan.
