News: Allotted flats cancelled, Mahira Homes buyers want action by DTCP & Haryana RERA-29-06-2023

A group of homebuyers of Mahira Homes 104, an affordable housing project, protested at H-Rera office on Wednesday against the authorities for not taking action against the developer.

The developer — Mahira Homes Pvt Ltd— who failed to complete its several affordable housing projects in the city recently cancelled the allotment of hundreds of allottees citing delay in payment of dues.The developer is not constructing the project and the district administration and DTCP are not taking action against them, leaving the homebuyers staring at an uncertain future after investing their hard earned money, homebuyers alleged.

At the protest, allottees demanded that the authority should ensure that the developer should not disappear, as only excavation works have been carried out at the site, after collecting more than Rs.120 crore from the allottees

Kamal Bhardwaj, president of Mahira Homes 104 buyers welfare association said, “Despite various orders by the HRera not to cancel the units of the allottees, who have paid a tleast 25 per cent cost of the units, the developer is adamant to cancel the units to serve its vested interests.”

The protesting allottees claimed that the authority in its order dated August 22, 2022 had directed the developer to take payments from the allottees as construction linked payment plan, but the developer is still demanding payments and is cancelling units of allottees illegally, unlawfully and fraudulently.

There are around 1,483 affordable units in the project at Sector 104 and almost all units have been sold out. The developer has collected more than Rs120 crore from the allottees, but presently, no construction work is being carried out at the site, alleged allottees.

The developer has collected at least 25 per cent cost of the units, but has not executed the Builder Buyer Agreement with allottees as per the Rera norms and regulations

Abhay Jain, counsel of the association, said the authority has already heard the arguments from both the sides, and the judgment is expected shortly. “The promoters of the project are powerful politicians of Haryana and they are trying to influence the judgement to exploit the allottees, who belong to the middle class, ” he alleged.

He added that the land owners of the project site have also lodged an FIR against the developers for cheating, fraud and forgery in regard to the collaboration agreement with them.
